December 13, 2019Legal Separation
A legal separation is similar to a dissolution of marriage in that an agreement will be reached regarding:
- Division of property;
- Spousal support/maintenance;
- Child custody; and
- Child support
Unlike a divorce, however, the two parties will remain legally married. A legal separation is often desired in situations where, for religious or other personal reasons, the couple wishes to keep the legal status of the marriage in place. Other reasons for becoming legally separated rather than divorced may include maintaining medical insurance for an ailing spouse.
Going through the process of a legal separation is virtually identical to that of dissolving a marriage and can be a difficult and emotional process. Even if you and your spouse are on friendly terms, you may still have some disagreements with particular issues. It is important to consult and work with an attorney who can help protect your rights and interests to ensure you have the opportunity to reach an agreement that will benefit you.
