Relocation

Relocation of one parent typically triggers modification of a parenting schedule. If a parent intends to move from their current geographic locale and wants to try to relocate children with him or her, and such a move will affect the timesharing/visitation of the other parent, timely, advance notice must be given to the other parent pursuant to Kentucky Family Court Rule 7(2).

Parties can address the question of future relocation within the terms of an initial Marital Settlement Agreement or Parenting Agreement, but each such Agreement should specifically address the issue of relocation. If an Agreement is silent on relocation, and parties are unable to later reach a mutual agreement should a relocation be proposed by either party, a relocation and parenting schedule hearing in front of a Family Court Judge will be necessary.
